Terms and Conditions
If your project is time sensitive, JOURNALSandBOOKS.COM, Inc. will guarantee on time satisfaction of any corporate and/or custom order project WHEN:
1. The client requests an "On-Time Guarantee" in writing; and clearly supplies to JOURNALSandBOOKS.COM, Inc., all of the project deadlines and constraints that may pertain to our successfully completing the project, by a single date certain. 2. The original order is marked "On Time or It's Free! Guarantee", and clearly states the agreed upon timeline correctly, with inclusion of the same single date certain, as supplied by the client.
3. To be eligible for this guarantee, all artwork and materials for that job, must be received by a date and time specified on the order. Upon arrival, receipt of all materials are date stamped by JOURNALSandBOOKS.COM, Inc., and are available for inspection by customers. 4. The order is duly approved and signed, by an officer of JOURNALSandBOOKS.COM, Inc. 5. All other terms and conditions of the order, and JOURNALSandBOOKS.COM, Inc.’s Entire Agreement (see: Severability and Integration), are agreed to, and have been complied with by the client, and the client’s agents, at all times. 6. This guarantee does not apply, if any cause of any late satisfaction, is due to circumstances beyond our control. These circumstances, may include (but are not limited to): riots, acts of war, acts of terrorism, strikes, delays in mail or freight collection or forwarding, customs delays, mechanical failure of equipment (as supported by an engineer's report), power outages, floods, blizzards, extreme severe weather or other natural disasters.
Failure of a customer to: provide promised artwork within 48 hours of the order date, approve samples within 24 hours of delivery, approve proofs within 8 hours of delivery, provide any required text, or components; or failure to respond to any written request for a decision by us, our agents, or our vendors, or to clearly communicate the same, to JOURNALSandBOOKS.COM, Inc. within 24 hours, SHALL BE GROUNDS FOR TERMINATION of any order's on time guarantee provision(s). Cancelation of any order's on time guarantee provision(s), shall NOT be grounds for nullifying any other obligation by either party. If the timeline is interrupted by the customer, then JOURNALSandBOOKS.COM, Inc. may deliver the order late (AS SOON AS POSSIBLE), and the customer will be charged as if the order was delivered on time.
Product Sample Service Samples are available on loan, for projects with budgets that can sustain our minimum order for that item, when customized. A shipping and handling fee, sufficient to cover costs of insured delivery is required. Product sample orders must be accompanied by full payment of all shipping charges, including any estimated shipping, customs or delivery handling costs. Customers must have a completed Billing Authorization Form, including valid credit card billing information, on file before any product sample orders will be accepted. All shipping costs will be billed to your credit card prior to shipment. If a sample, is not returned within 30 days, the credit card on file will be billed for the current retail price of that item. In the event, that a corporate or custom order is placed, the client may keep any samples electing to have the cost added to their order.
Sample Condition Samples are not always in new condition. While we don't send out ragged books, a sample might be slightly worn (some of our samples are literally world travelers!). In addition, sometimes samples are a different color or a design prototype, that we made prior to the production of a final product. Rest assured, we sell only new merchandise and your custom order will be produced to the highest quality standards and to your complete specifications. We automatically send out the best looking sample we have. If you think that a slightly worn, different color or design prototype sample will not suffice -- say, for a presentation to people who may not be able to look beyond minor differences -- please tell us in advance. In that case, you may need to simply purchase a single piece to own, or occasionally, we are able to introduce a new piece to our sample inventory. We understand that even a slightly roughed up or different colored sample could hurt the prospects of certain presentations, so we will do our best to accommodate you. If the product sample is a design prototype, there will be a description of any changes that have been made, to the final product design, included with the sample. e.g. “interior pages have rice paper interleaves” or “exterior cover is double stitched rather than single stitched”.
Sample Return
Kindly, return the sample to us in the same condition as it was received (less extremely minor wear). All product samples, are digitally imaged prior to loan (to aid in our determination in the unlikely event of excessive wear or damage). JOURNALSandBOOKS.COM, Inc. shall be the final judge of acceptable wear. In the event, that a sample is deemed by us to have excessive wear or damage, you will be charged a fee up to the full retail price of the item. The fee shall be determined, by our estimation of the retained value of the item; which considers the condition the item was sent to you in, and accounts for any costs incurred to bring the item back into service, as a sample, when possible. We are very fair and reasonable, but if you spill coffee on an item consider keeping it!

Minimum Order and Low Order Fees
Minimum order quantities for customization projects vary based on the products involved, customization desired, and the manufacturing processes to be employed. Projects falling below the minimum quantity requirements for customization may be considered with the addition of a sufficient minimum order fee to compensate for a short run. Corporate customers receiving a discount must meet minimum volume levels or they will be re-billed at the pricing they qualify for. Production Overruns and Underruns Most custom items are shipped and invoiced, in a quantity that ranges between 5% more than you ordered, and 5% less than you ordered. This is an industry standard practice, and occurs due to the nature of the custom manufacturing process. Depending on the item and the customization required, we often begin the manufacturing process, with a few more items than you ordered (typically 5% more). Inspections during customization, assembly, and finishing reject all those with imperfections. Sometimes, the manufacturing process yields no imperfections, and the end result is 105% of the quantity ordered. On rare occasions, due to a high amount of rejections, there are not enough perfect items to fill your order to 100%. In any case, you will be re-invoiced only for the number of products that are actually shipped, after passing our final quality inspection.
Underrun Order Fulfillment
If the custom manufacturing process, yields less than 95% of your original order, we will remake enough goods to satisfy the plus or minus 5% thresholds. You will not be charged additional setup fees, and will only have to pay for the sum total of the items finally produced. In the event, of a production underrun exceeding 5%, JournalsandBooks.com, Inc. may, at its option, ship you the items that are ready, sending the remaining items when they are ready. We do our best, to keep the manufacturing process open, and have components and supplies available for immediate satisfaction, in the event of production underruns, and will notify you if there will be any delays.
Hand-Crafted Products Color variations due to hand dying and slight blemishes are not defects, but are natural traits inherent in handmade goods. Hand-tooled leather, hand-worked metals, hand-polished plastics, and other hand-crafted items are truly one-of-a-kind. Each is unique and won't look perfect like they were mass-produced because they weren't. And that is what makes them beautiful.
Handmade Item Color and Size
Hand-dyed, organic-dyed, and naturally-processed items, may inherently have a significant variation in color from piece to piece, as well as, color variation (or dye spots) on the same piece. Some handmade items vary in size, from piece-to-piece, as an artisan makes accommodations for the differences inherent in the materials they use. Especially, items made with handmade paper, leaves, bark, seeds and shells. Carved items, and items that utilize the shape of the natural resources themselves (such as bamboo stalks, wood branches, or stones) will have an significant overall variation in shape, from piece-to-piece. Photos, samples, and descriptions of any handmade items, supplied by JOURNALSandBOOKS.COM, Inc., are general representations of what a single piece might be like; NOT, a definition or specification, that can be used to determine whether a piece is representational of that particular product.
Payment All orders must be prepaid, either by credit card, or check (allow time for check to clear before work can begin or items can be shipped). Orders must be accompanied by full payment of all charges, including estimated costs. Customers must have a completed Billing Authorization Form, including valid credit card billing information, on file before any orders will be accepted. Quoted Pricing Pricing on orders and quotes, does not include handling, insurance, freight, crating, or applicable sales tax, unless expressly stated. JOURNALSandBOOKS.COM, Inc. reserves the right to implement price changes, at any time, before your order is approved. All quotes are current, when issued, and not a guarantee of future pricing nor availability. In the event, that a price increase occurs during the term of an order, PRIOR to order fulfillment, the original price listed on the order will be valid (unchanged), UNLESS, production of the order has been fully or partially delayed by the customer, for more than two days. Orders placed for future delivery, in excess of 30 days, are not a guarantee of pricing, nor availability, unless the order is 100% pre-paid.
Billable Amounts
Additional costs, not paid in advance, are due when invoiced, and we will charge your credit card when due. If any billable amount can't be satisfied, by immediate credit card billing, a service charge of 2% per month may be added, to the unpaid balance of any account.
Order Changes
All requests for changes, to any existing order, due to a customer's ordering error, are subject to labor and material charges; as determined by JOURNALSandBOOKS.COM, Inc. Only written requests submitted in a timely manner, will be considered. Please contact us immediately, if you find an error of ANY KIND related to any order or quote. Order related typographical, data, and processing errors, or omissions shall be correctable by either party, by serving expedited written notice to the other party. In the event of an honest mistake, original intentions will be honored, with as little inconvenience or added cost as possible.
Termination/Order Cancelation
Termination of orders received, may not occur without the prior written agreement of JOURNALSandBOOKS.COM, Inc. Customers, are responsible for production charges incurred, up to the time of any accepted cancelation. If goods have been ordered, purchased, or set aside from inventory, as a direct result of your order, it is likely that the order may NOT BE CANCELED.
Requests for order cancelation must be tendered in writing. JOURNALSandBOOKS.COM, Inc., at its sole discretion, may agree to terminate your order; after you have paid a restocking fee, equal to 15% of the Full Retail Value of the item, plus any extras. In no event, shall we refund any customization costs, for any items canceled including costs for: art, production, screens, dies, transfers, decals, leafing, engraving, embossing, debossing, stamping, painting, setup, or any rush service, shipping, or handling fees, incurred by us, as a result of any order cancelation.
Failure of customer to provide promised artwork, approve samples, approve proofs, provide any required text, or components, or failure to respond to any written request for a decision by us; SHALL NOT BE GROUNDS FOR TERMINATION OR ORDER CANCELATION.
Defective Product Return
Claims for short shipment, or claims for any defective product, resulting from a defect in workmanship, will be replaced at no cost to the purchaser, provided; claims are made in writing within five (5) business days of order receipt. No claims thereafter, will be considered.
Damages Due to Shipping Discrepancies and claims for lost or damaged shipments, must be made within five (5) business days of receipt of product. If UPS, FedEx or any other delivery service, delivers cartons that are obviously damaged during shipping, refuse the cartons that are damaged, and contact JOURNALSandBOOKS.COM, Inc. immediately regarding such actions. Severability and Integration Unless otherwise specified herein, this webpage is a subset of your Entire Agreement. Your Entire Agreement includes: 1. Our Terms, Conditions, and Privacy Policies (see: http://jbsecure.com/privacy). 2. Our Shipping Information and Website Shipping Agreement (see: http://jbsecure.com/shipping). 3. The above five items, set forth the Entire Agreement and understanding of the parties, relating to the subject matter hereof, and merges all prior discussions and writings, between them, with respect to the contents of this agreement. If any provision (or part thereof) of this Entire Agreement, is determined by a court of competent jurisdiction, as part of a final non-appealable ruling, government action, or binding arbitration, to be invalid, illegal, or otherwise unenforceable, such provision shall be enforced as nearly as possible in accordance with the stated intention of the parties, while the remainder of this Entire Agreement shall remain in full force and effect and bind the parties according to its terms. |
